Vietnam Work Visa (Visa LĐ1, Visa LĐ2) – Application Procedures

To work legally in Vietnam, foreign nationals must obtain a work visa (labor visa) either from the Vietnamese Embassy abroad or from the Immigration Department in Vietnam. The Vietnam Work Visa is issued based on labor permits and is designated as LĐ1 or LĐ2.

What is the Vietnam Work Visa and Who is Eligible?

The Vietnam Work Visa is a type of visa issued to foreign nationals entering Vietnam for employment purposes. It is applicable to individuals who meet the requirements for a labor permit or are exempt from the labor permit requirement under the regulations of Vietnamese labor laws.

Depending on the circumstances, foreign nationals will be issued either the LĐ1 or LĐ2 visa:

  • Visa LĐ1: Issued to foreign nationals working in Vietnam who do not require a labor permit, except for cases specified in international treaties to which Vietnam is a party.
  • Visa LĐ2: Issued to foreign nationals working in Vietnam who require a labor permit.

The maximum validity period for Vietnam Work Visas is 2 years. If the labor permit is valid for less than 2 years, the work visa duration will match the validity period of the labor permit.

Requirements for Applying for Vietnam Work Visa:

  • Valid passport or travel document.
  • Sponsorship from an organization, institution, or individual in Vietnam.
  • Not falling under restricted categories for entry.
  • Foreign workers must have a labor permit (or confirmation of labor permit exemption).
  • Electronic visas are granted for foreign nationals with passports not requiring diplomatic visas.

Vietnam Work Visa Application Process:

For Applicants Outside Vietnam:

Step 1: Prepare the application documents, including the Letter of Approval from the Immigration Department for the work visa.

  • Original passport with a valid period.
  • Authenticated copy of the labor permit (for LĐ2 visa) or Labor Permit Exemption Certificate (for LĐ1 visa) of the foreign national.
  • Business license of the sponsoring company.
  • Form NA2 – Application for entry permit for foreigners coming to Vietnam.
  • Other required forms and documents specified by the Immigration Department.

Step 2: Submit the application and receive an appointment for the result. After preparing the complete set of documents, visit the Immigration Department to submit the application and receive an appointment for the result. For visas obtained at the Vietnamese Embassy/Consulate abroad, additional fees for fax services are required.

Submission Locations:

  • Northern Region: Immigration Department in Hanoi, 44 – 46 Tran Phu Street, Ba Dinh District, Hanoi.
  • Southern Region: Immigration Department in Ho Chi Minh City, 333 – 335 – 337 Nguyen Trai Street, District 1, Ho Chi Minh City.

Step 3: Receive the entry permit document. If the entry permit is approved, the Immigration Department will provide the necessary documents to the sponsoring company or organization within approximately 5-10 days.

Step 4: Inform the foreign national. After receiving the entry permit, the sponsoring company or organization should promptly inform the foreign national who wishes to enter Vietnam for employment purposes. The company can send the entry permit document to the foreign national via email or express mail for them to complete the visa application process at the Embassy/Consulate or upon arrival at the airport.

Step 5: Obtain the visa and pay the visa fee. Upon arrival in Vietnam, the foreign national can obtain the work visa by filling out Form NA1, attaching a 4×6 cm photo, the original passport, and the entry permit document. The visa fee is paid, and the visa is issued in Vietnam.

For Applicants Already in Vietnam:

Step 1: Prepare the documents for visa extension at the Immigration Department in Vietnam. Submit the application at the Immigration Department, pay the state fee, and receive an appointment for the result.

Submission Location: Submit the application at the Immigration Department under the jurisdiction of the sponsoring company.

Step 2: Receive the work visa (labor visa) document. If the work visa is approved, the Immigration Department will provide the necessary documents to the sponsoring company or organization within 5 working days.

Step 3: Inform the foreign national. The sponsoring company or organization should promptly inform the foreign national about the approval of the work visa. The foreign national can check the accuracy of the information on the issued visa. The visa will indicate the visa duration and personal information of the visa holder.

Processing Time and Visa Fees:

  • Processing Time: Generally, the processing time for a work visa is within 5 working days. However, the approval may vary based on the applicant’s nationality and other factors. Note that Saturdays, Sundays, and public holidays are not included in the processing time.
  • Visa Fees: The visa fee for work visas is determined by the Immigration Department. Additional fees may apply for visa processing at specific embassies/consulates, and these fees should be verified beforehand.
